Two new labor complaints filed against Nintendo and contracting firm Teksystems

Nintendo of America settled a prior labor complaint in 2022.

Nintendo is the subject of two new worker complaints filed to the United States’ National Labor Relations Board over the past month, Game File has learned.

Both complaints allege that Nintendo of America and outside firm Teksystems violated parts of the National Labor Relations Act.

The complaints were filed on December 9, 2025 and January 6, 2026 by an individual or individuals whose identities are not publicly available.

Online listings of both cases were light on details, as is standard.

Both allege violations of clauses 8(a)(1) and 8(a)(4) from the labor act.

  • 8(a)(1) bars employers from interfering with or restraining employees from their right to self-organize, “to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection.”

  • 8(a)(4) prohibits employers from firing, discharging or otherwise discriminating “against an employee because he has filed charges or given testimony under this Act.”

At this early stage, there aren’t many more specifics to go by, and it’s impossible to discern which concerted activities Nintendo and Teksystems allegedly interfered with—nor the nature of any contested firing or refusal to hire.

Nintendo of America typically has contracts with firms such as Teksystems to fulfill a range of key jobs, including game-testing and customer service.

The December and January complaints were assigned to the NLRB’s Region 19 in Seattle, and both have led to a signed charging letter against the employers. Despite the difference in the date of the complaints, both charging letters are dated January 7, according to the NLRB’s database and were published at that time.

Representatives for Nintendo and Teksystems did not reply to Game File’s request for comment by press time.

An NLRB complaint is, by its nature a complaint, one that involves charging letters whose signatories attest to their accuracy. Complaints can lead to a settlement or a hearing before an NLRB administrative law judge as both sides get their say.

Nintendo has not been subject to many labor complaints, but did settle one in 2022.
